1. Introduction

These Terms and Conditions ("Terms") govern your use of the Nurturely platform ("Product"), provided by Entrext Labs ("we," "us," or "our"). By accessing or using our Product, you agree to be bound by these Terms. If you do not agree, you must not access or use the Product.

2. User Accounts and Eligibility

To use certain features of the Product, you must register for an account. By registering, you warrant that:

• You are legally capable of entering into binding contracts.
• You are a parent or legal guardian if creating an account to assess a student under the age of 18.
• The information you provide is accurate, complete, and current at all times.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Intellectual Property Rights

Our Technology: The Product, including its "Neural Engine," code, design, features, and functionality, are and will remain the exclusive property of Entrext Labs and its licensors. The Product is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Your Data: We do not claim ownership of the data you provide (e.g., student assessment responses). You grant us a license to use, reproduce, and analyze this data solely for the purpose of providing the service to you and improving our algorithms, in accordance with our Privacy Policy.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Product for any illegal purpose or in violation of any local, state, national, or international law.
• Attempting to reverse engineer, decompile, disassemble, or derive the source code of the Product.
• Sharing your account credentials with third parties to allow them access to premium features without payment.
• Harassing, threatening, or defaming any person or entity.
• Interfering with or disrupting the security, integrity, or performance of the Product.

5. Limitation of Liability and Disclaimers

Disclaimer of Warranties: The Product is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or completeness of the analysis or insights provided. Nurturely provides educational and developmental insights, not medical or psychological diagnoses.

Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Entrext Labs, its affiliates, agents, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Product.

6. Termination

We may terminate or suspend your account and bar access to the Product immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Product will immediately cease.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Product after any revisions become effective, you agree to be bound by the revised terms.
